Sutton Scoopers – Terms of Service
1. Introduction
These Terms of Service (“Terms”) govern the provision of dog waste removal services (“Services”) by Sutton Scoopers, a company registered in the United Kingdom. By requesting or receiving Services from Sutton Scoopers, the customer (“Client”) agrees to be bound by these Terms in full. Please read them carefully prior to engagement.
2. Scope of Services and Limitations
2.1 Exclusions and Inaccessibility
Sutton Scoopers shall not be required to collect waste from areas deemed inaccessible or hazardous, including but not limited to steep inclines, thick vegetation, or frozen ground. Where such conditions exist, the Client shall be notified, and those areas shall be excluded from service.
2.2 Weather Disruptions
In the event of severe weather (including but not limited to snow, ice, flooding, or high winds), Sutton Scoopers reserves the right to postpone services. The Client shall be informed, and no additional fees shall apply in such circumstances.
3. Booking and Scheduling
3.1 Service Request Methods
Service appointments may be scheduled via the Sutton Scoopers website, email, or telephone. Upon confirmation, a notification will be issued outlining the agreed date and frequency of service.
3.2 Service Frequency Options
Clients may elect for one-time, weekly, fortnightly, monthly, or twice-weekly services, subject to availability and confirmation by Sutton Scoopers.
3.3 Property Access
The Client is responsible for ensuring unobstructed access to the service area on the scheduled date and time. Inaccessibility due to locked gates, obstructed paths, or other preventable barriers may result in a rescheduling fee.
4. Pricing and Payment Terms
4.1 Determination of Charges
Charges for Services are calculated based on factors such as property size, number of pets, and frequency of service. Prices shall be confirmed prior to service commencement.
4.2 Payment Methodology
Unless otherwise agreed in writing, payment is due in advance of each service. Clients will be required to establish a direct debit arrangement prior to the initial visit.
4.3 Delinquent Accounts
If payment is not received within five (5) calendar days from the invoice date, Sutton Scoopers reserves the right to apply late payment fees and/or suspend services until full payment is received.
5. Customer Obligations
5.1 Safe Working Environment
The Client is required to maintain a safe environment for service personnel, including the removal of sharp objects, toxic plants, or other hazards from the working area.
5.2 Pet Management
Where pets are present, the Client must ensure that aggressive or protective animals are securely contained during the time of service. Sutton Scoopers reserves the right to defer or cancel a visit where safety is compromised.
6. Cancellations and Rescheduling
6.1 Cancellation by Client
Cancellations must be communicated at least twenty-four (24) hours prior to the scheduled service time. Failure to do so may result in a charge equal to 50% of the agreed service fee.
6.2 Failure to Grant Access
Where access to the property is not possible upon arrival, and no prior cancellation or rescheduling has occurred, Sutton Scoopers may apply a rebooking charge or adjust the schedule at its discretion.
7. Liability and Indemnity
7.1 Limitation of Liability
While Sutton Scoopers exercises due care in performing Services, it shall not be held liable for incidental property damage, including minor impacts to lawns, fencing, or landscaping, except where such damage arises from proven negligence.
7.2 Health and Environmental Risks
The Client agrees to hold Sutton Scoopers harmless from any allergic reactions, health complications, or contamination resulting from the presence or handling of pet waste on the property.
7.3 Injuries and Third-Party Claims
Sutton Scoopers disclaims liability for injury or loss sustained by pets, household members, or third parties, except in cases of gross negligence or willful misconduct by its staff.
8. Data Protection
All personal data collected shall be processed in accordance with the UK Data Protection Act 2018 and the General Data Protection Regulation (GDPR). By accepting Services, the Client consents to the use of their data for service delivery, billing, and necessary communications.
9. Termination of Services
9.1 Client Termination
The Client may terminate Services at any time by providing notice in writing (via email or post). No refund shall be issued for Services already rendered.
9.2 Provider Termination
Sutton Scoopers may suspend or terminate Services if these Terms are breached by the Client, or if staff safety is placed at risk during service provision.
10. Amendments
Sutton Scoopers reserves the right to amend these Terms at any time. Updated Terms shall be posted on the company website or communicated via email. Continued use of the Services constitutes acceptance of such amendments.
11. Force Majeure
Sutton Scoopers shall not be held responsible for delays or failure in performance arising from causes beyond its reasonable control, including but not limited to acts of God, extreme weather, natural disasters, government actions, or public utility failures.
12. Governing Law and Jurisdiction
These Terms shall be interpreted and enforced in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Prior to litigation, both parties agree to attempt mediation in good faith.
